Duti Setem


Apa itu duti setem?


Duti setem adalah satu taksiran cukai atau pungutan duti setem yang tertakluk pada akta setem 1949.


Akta Setem 1949 memperuntukkan pengenaan duti atau cukai mengikut nilai hartanah dari setiap transaksi hartanah.


Pembayaran cukai atau levi ini adalah wajib pada setiap transaksi hartanah melainkan adanya pengecualian tertentu dari pihak kerajaan.


Ini termasuklah transaksi penukaran nama dari aktiviti jualan atau hadiah, di mana walau apa jenis transaksi yang dilakukan pemilik asal pada pemilik baru, duti setem tetap akan dikenakan pada transaksi itu.


Di dalam kes pembelian mana-mana urus niaga, kontrak jualan dan belian anda sebagai pemilik baru akan dikenakan duti mengikut nilai harga yang berkaitan.



Sebagai contoh apabila anda membeli hartanah bernilai RM700,000, anda dikehendaki membayar duti setem mengikut carta dibawah;


RM100,000 yang pertama: 1% dari RM100,000 pertama atau RM1.00 bagi setiap RM100 atau sebahagian daripada RM100.


RM100,000 keatas tetapi tidak melebihi RM500,000: 2% dari 100,000 hingga ke RM500,000 atau RM2.00 bagi setiap RM100 atau sebahagian daripada RM100.


Melebihi RM500,000: 3% pada RM500,000 seterusnya atau RM3.00 bagi setiap RM100 atau sebahagian daripada RM100.


Jika di simulasikan pembayaran duti pada hartanah yang berharga RM700,000 adalah;


Harga Rumah

RM100,000 pertama – 1% x RM100,000 = RM1,000 duti Setem yang dibayar (baki harga rumah – RM600,000)


RM400,000 seterusnya – 2% x RM400,000 = RM8,000 duti setem yang dibayar (baki harga rumah – RM200,000)


RM200,000 seterusnya – 3% x RM200,000 = RM6,000 duti setem yang dibayar (Jumlah harga rumah RM700,00)


Ini bermakna jumlah bayaran duti setem pada rumah ini adalah RM15,000 sahaja
